These Terms and Conditions (‘The Terms’) are the Terms that apply when the users (‘you’ ‘your’, ‘the user’) access and use the features and services of the website https://www.allthebeauties.com, any other variations of the website (e.g. offers.allthebeauties.com) or any other sites owned and controlled by NAELIA LLC. We are NAELIA LLC, trading as ALL THE BEAUTIES and any reference to we/us/our/AllTheBeauties in these terms and conditions refers to NAELIA LLC.

We like to interfere with you using interactive services such as User Reviews, and these Terms and Conditions govern as well and apply to these interactive services.

We also like to interfere with you using online social media platforms, including but not limited to Facebook (www.facebook.com/allthebeautiescosmetics), Twitter (https://twitter.com/_AllTheBeauties), Pinterest (https://www.pinterest.com/allthebeautiescosmetics), Instagram (https://www.instagram.com/allthebeautiescosmetics). These social media platforms constitute Third Party Sites (‘Third Party Sites’) whose Terms and Conditions are not controlled by All The Beauties. In addition, our Terms of Use and Rules apply neither to these interactive platforms nor to any other Third Party Sites that we do not own.

 

Who We Are

We are NAELIA LLC (trading as Allthebeauties.com), a company incorporated in the State of Wyoming, USA, whose registered office is 1910 Thomes Avenue, Cheyenne, WY 82001. Consequently, irrespective of your place of residence, any purchase you make, any order or dispute will be governed by these T&Cs and the laws of the State of Wyoming. Any use of currencies other than the US Dollar are purely for your ease.

Our online store is hosted on Shopify which provides us with the online e-commerce platform that allows us to sell our products and services to you.

 

Agreement

By placing an order with us for products that we sell on the Site ("Products") you must have read, understood and agreed to these Terms & Conditions ("T&Cs"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.  These Terms and Conditions include general terms and conditions for use of this Site, terms and conditions regarding our Services and terms and conditions regarding the sale and purchase of products on the Site. By accessing All The Beauties website or when you place orders to purchase any of the Products on the Site you agree to be bound by these T&Cs, regardless of the means you are using to access our Site or Sites (whether using a computer or mobile phone, using an smartphone app, for example). Please read these Terms and Conditions carefully as they affect your liabilities and rights under the law. If you do not agree to any of our terms, then please cease accessing or using our website.

Our Privacy Policy, Refunds & Returns Policy, Shipping Policy, Website Terms of Use and Cookie Policy also form part of these Terms and Conditions. Therefore, to place orders and purchase any of the Products on The Site you also agree to be bound by them. We recommend you read them carefully before placing an order.

These Terms and Conditions apply to all users of the site, including without limitation users, vendors, customers, merchants, and/ or contributors of content.

Through our services (‘our Services’, ‘The Service’, our Service’, ‘The Services’), we strive to offer to you an integrated inventory, from high-end to affordable beauty products and give you useful tips on all the latest beauty trends.

‘Our Services’ means any information and services offered by All The Beauties through or via The Site. To avoid any doubt, any electronic information supplied to you is part of Our Services and not a Product.

 

Online Store Terms, Compliance with Applicable Laws and Eligibility

A breach or violation of any of the Terms will result in an immediate termination of your Services.

By agreeing to these Terms of Service, you represent that you are 18 years of age or older to purchase a Site Product and that you register your real personal details like your real name, address, phone number, e-mail address and any other details requested.

The Site and the Service is based in the State of Wyoming, United States. Whether inside or outside of the United States, you are solely responsible for ensuring compliance with the laws of your specific jurisdiction. The purchase of Products through the Site is strictly limited to parties who can lawfully enter into and form contracts on the Site in accordance with U.S. law. We reserve the right to make changes to this Site and Terms of Use at any time.

 

Children Under the Age of 13

We comply with the Children’s Online Privacy Protection act of 1998, and to protect children’s privacy and safety online, we disallow children under 13 from using our services altogether. Our policy is not to collect any personal information from any child under 13 years old, and our policy applies but is not limited to signing up for our promotions or services.  If you are under the age 13, you can browse our website, but you should not create an account, use our services, or make any purchases from us.

We do not sell our products or services to children. If you are above the age of 13 but under the age of 18, you must have your parent’s or guardian’s permission form on file to use this Site.

To register as a ‘User’ (‘Registered User’) for a personal account with us, you must purchase product from us or subscribe to our newsletter and you need to be of legal age in your state or country of residence at the time of registration. Resale of a Product or Service

All Products purchased, Services we might offer you and Samples you might receive from us are for personal and domestic use only and are not for resale. Therefore, you may not sell or resell any of the products or services, or any samples or gifts that you may receive from us.

We reserve the right to refuse an order. We reserve the right, in our sole discretion, to limit, prohibit or cancel quantities purchased per person, per household or per order, if in our sole judgement, these orders appear to be placed by dealers, distributors or resellers. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

 

Order Acceptance and Contract Formation

Upon placing an order with All the Beauties, it is subject to acceptance and availability. Order acceptance and the creation of a contract between All the Beauties and the customer will start at the time the products ordered by the Customer are dispatched to be delivered to the Customer’s address. Any order acknowledgement and subsequent update email (s) doesn’t guarantee that the order has been confirmed by us, until the products ordered are dispatched for delivery to the Customer’s address. Even in the unlikely event that a Dispatch Confirmation is not sent due to a processing error, the contract between Us and You (the ‘customer’) will start when we dispatch the Products to you.

Please note that your order constitutes an offer to All the Beauties to purchase a Product from us, and we reserve the right to refuse orders for Products.

 

Online Ordering Process

The ordering process from All the Beauties includes the following steps:

(a)         You add the items you wish to order from our range of products to your shopping cart.

(b)         You select your preferred delivery method.

(c)          You enter a valid delivery address, billing address and payment method details.

(d)         You click the equivalent button to submit and finalize your order.

Before submitting your order, you may correct and review the information submitted, the items chosen and their prices, including delivery costs.

Although we take all reasonable steps to keep your personal data and payment details secure, however, in the absence of negligence on our part and, subject to applicable laws, including laws relating to data protection and privacy, we hold no responsibility and will not be held liable for any loss suffered if a third party procures unauthorized access to any data you provide when accessing or ordering from our Site.

Upon delivery of products to the specified delivery address, title and risk of loss shall pass to you. We will not be liable for any reason, if you provided incorrect correspondence details (for example, wrong delivery address), or if you failed to collect the products you ordered from the specified delivery address. In addition, we shall not be held liable if our delivery partner failed to inform you for an attempted delivery of the products. In the case that you have failed to collect the products that you ordered from our delivery partner and the parcel is returned to us, upon receipt of the product(s), we will charge you for the costs incurred from sending the parcel to you and paying for its return. After the deduction of these charges, we will refund you for the amount remaining.

In the event that any change in your address, personal information or payment card details occurs, you are solely responsible to notify us immediately.

By submitting your order with us, you make an offer to buy the products in the shopping cart. This order does not constitute our acceptance, nor does the automatic first confirmation email constitute acceptance, it is only a confirmation that we have received your order. Our acceptance of your order starts when we dispatch your products, and, upon dispatch, you will receive a second confirmation email that forms a binding contract between us and you (The Customer).

 

Product Title

The Products shall be owned by you once we have received payment in full for the Products. You become liable and responsible for the products you have ordered when they are delivered to you. If we refund any payment for the Products to you, legal ownership of the Products will immediately transfer back to us.

 

Disclaimer of Warranties and Limitation of Liability

The information available on or through this Site, and the Services supplied via or in connection with this Site, including the editorial material provided by us, is intended as information only and does not constitute advice or medical advice, nor does it intend to be a substitute for professional medical advice, diagnosis or treatment. Prices and Delivery Charges

Delivery Information

This section should be read in conjunction with and forms part of our Shipping & Delivery Information.

Please note that items ordered, may be split into different fulfillments and therefore their arrival time will vary. For this reason, our max delivery period is a maximum of 60 days. However, if the arrival of any of the products ordered has not been fulfilled at the end of this delivery period or any other delivery period specified by us (if stated otherwise when buying a specific product), then contact us and we will be happy to resolve the issue.

Please note that shipment for certain items that are considered as hazardous by the U.S. Department of transportation, maybe prohibited or restricted.

 

Availability

All Products are subject to availability. Validly stated prices on our Site remain in effect for so long as the Products are available or as otherwise stated on our Site. Payment

Customers from outside the U.S must pay in U.S. Dollars unless otherwise specified. If your credit or debit card payment is not processed successfully for any reason, we reserve the right to reattempt to process payment. If you do not want us to reattempt to process payment, you must notify us to cancel your order within 48 hours after sending you this email.

Discount Codes

From time to time we issue Discount Codes or other promotional codes that may involve discounts and gifts or samples. You may only use one discount code with each order. When entering codes, you must take care as they are case and space sensitive. Codes are valid for a set length of time.

Delivery times during sale period might be longer than expected, due to the large volume of orders place during the sales period. We apologize in advance for any inconvenience this might cause. Competition and Claiming Of Prizes

From time to time, All The Beauties will run competitions, promotions and free prize draws. By entering the competition entrants will be deemed to have read and understood these Terms and be bound by them. Each competition may be subject to additional terms and specific instructions that will be made available at that time.

Competitions are not open to employees or immediate family member of employees of All The Beauties and of the Promoter and anyone else directly connected with the creation and organization of any particular competition. Entrants must be aged 18 or over to enter the competition or, if they are under 18, they may only enter the competition with their parents’ written permission.

Only one prize will be awarded per entrant.

The winner will be selected in a random draw, after the closing date of the competition, from all correct answers received and will be notified within 30 days.

Delivery time of the competition prize is subject to our Shipping and Delivery terms.

To be eligible to enter any competition, the entrant must:

• Send his entry before the closing date specified

However, if the dispute that arises cannot be resolved using our Customer Services, you irrevocably agree that the courts of the State of Wyoming shall have exclusive jurisdiction to settle any dispute or claim.

 

Refunds Policy

This section should be read in conjunction with the section entitled Returns & Refunds Policy. Please view the terms of our Refunds policy for analytical information.

We, at All The Beauties take your satisfaction as a customer very seriously and will do our best to resolve any issues that might arise.

We reserve the right to alter the Returns & Refunds Policy without prior notice.

We do not currently offer exchanges. However, in the unlikely event you have received a defective item, our support team will inspect your case, and if there is proof of damage or defect, we will happily action a refund. In order to be entitled to claim a refund, the product has to be unopened, in its original packaging and with all original retail seals unbroken. We will not issue a refund where it has been proven upon inspection that there is no error or damage in the item for which you have reported such, or damage cause by your misuse.

You have the right to claim a refund within 14 days, beginning the day after the day you receive the goods. In addition to your legal rights, you may be entitled to an offer of store credit note instead of refund.

Please note that items ordered, may be split into different fulfillments and therefore their arrival time will vary.

To process your refund claim, please contact our Customer Service Team at: support@allthebeauties.com, as soon as possible upon receipt and before the expiry of the aforementioned 14 days period, using receipt invoice to prove the date you received the item.

Please contact us writing a clear statement and using the dispatch note, invoice or the order number of the item for which you claim reimbursement. Typically, you must include your name, address, order date and number, as well as photos that constitute proof of your claim for reimbursement.

We will issue a full refund for the total amount plus tax paid by the customer, at the time of purchase. Please note that any discounts applied (e.g. due to Promo codes) will automatically be factored into the amount for refund.

Please note that original shipping fees, if applicable, are not eligible for refund.

Promotional sale products (for example Cyber Monday, Black Friday) are not eligible for refund. We regret that sale products cannot be refunded. Gift cards, samples and gifts with purchase cannot be refunded.

According to US Federal Law, consumers who are caught engaging in return or refund claim fraud may face theft charges.

Please allow up to 4 working days for your refund claim to be processed by us.

Once you are eligible for a refund and the refund amount has been agreed, we will process you refund without delay. Upon acceptance for a refund, we will send you an email confirmation. Please note that from the time of issue, it may take up to 2 weeks for the refund to show to your account, depending on different banks and methods of payments.

 

Right To Cancel

Unfortunately, you cannot cancel an order, once the order has been shipped. But you can cancel an order, provided that the order is not yet shipped out. To do so, you will have to contact us right away through our website’s contact form and let us know about your intention to cancel your order. Please provide your order number, so we can proceed with the cancelation of your order as soon as possible. We regret that once an order has been dispatched, you are not able to cancel it.

 

Free Gift With Your Purchase

From time to time and as a way of promoting our Site, we may include a free gift with your purchase. This gift is subject to availability and we will offer only one gift per transaction.
